A number of new provisions in relation to adoption are in force (as of 5 January 2018) under the Adoption and Care Planning (Miscellaneous Amendments) Regulations 2018.
Under the new regulations there are specific provisions for disclosure of certain information by one adoption agency to another.
The regulations amend the Disclosure of Adoption Information (Post-Commencement Adoptions) Regulations 2005, to the effect that adoption agencies can share any adoption information kept in accordance with s56(1)(a) Adoption and Children Act 2002 with another adoption agency as it thinks fit for purposes related to its functions (or the receiving agency’s functions) as an adoption agency.
The Care Planning, Placement and Case Review (England) Regulations 2010 is amended to enable the LA looking after a child to transfer that child’s case record to an adoption agency if it is in the child’s interests (a written record of the transfer must be kept). Source: www.legislation.gov.uk.
